What’s the lawsuit about?
The lawsuit seeks to recover allegedly unpaid overtime pay for non-exempt, hourly-paid nurses that worked for Interstaff at a U.S. healthcare facility which contracted with Interstaff, and either: (1) were required to complete off-the-clock trainings, and/or (2) received extra payments, and who worked in excess of forty (40) hours in at least one workweek at any time on or after December 12, 2022.
Plaintiff Lilian Awino Nyawara (“Plaintiff”) alleges that nurses are owed compensation, including overtime pay, under the FLSA. Specifically, the lawsuit alleges that Interstaff violated the FLSA by failing to include non-discretionary compensation into nurses’ regular rate of pay for purposes of calculating nurses’ overtime pay, resulting in unpaid overtime wages. The lawsuit also alleges that Interstaff violated the FLSA by requiring that nurses complete training once in the U.S. without paying nurses for all hours that mandatory trainings took to complete, resulting in unpaid off-the-clock work. Plaintiff alleges that she and all employees similarly situated are entitled to recover unpaid wages and overtime premiums for all hours worked when they worked more than forty (40) hours a week, plus liquidated damages in an amount equal to unpaid overtime, interest, reasonable attorneys’ fees, and court costs.
Interstaff denies all claims that have been asserted and disputes any wrongdoing or liability.
